1. ACCEPTANCE OF TERMS

By purchasing, accessing, or participating in the PCOS to Pregnancy Protocol (the "Program"), you ("User," "Participant," or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Program.

The Program is offered by Dr. Steven Palter and his authorized representatives ("we," "us," "our," or "Provider"). These Terms constitute a legally binding agreement between you and the Provider.

2. IMPORTANT MEDICAL DISCLAIMERS

2.1 No Medical Advice or Treatment

THE PROGRAM IS FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The information provided is not intended to replace professional medical care or establish a doctor-patient relationship. You should always consult with a qualified healthcare provider before:

  • Starting any new dietary, exercise, or lifestyle program

  • Making changes to existing medical treatments or medications

  • Implementing any recommendations from the Program

  • If you have pre-existing medical conditions or health concerns


2.2 FDA Compliance Statement

These statements have not been evaluated by the Food and Drug Administration. This program is not intended to diagnose, treat, cure, or prevent any disease. The Program provides educational information about nutrition, lifestyle, and wellness approaches but does not provide medical treatment.


2.3 Individual Results Disclaimer

INDIVIDUAL RESULTS MAY VARY. No guarantee is made regarding your individual results, outcomes, or success from participating in the Program. Factors affecting results include but are not limited to: individual health status, adherence to recommendations, genetics, pre-existing conditions, concurrent medical treatments, and other lifestyle factors.


3. SCOPE OF SERVICES

3.1 Program Components

The Program includes:

  • Educational content and materials

  • Nutrition and lifestyle guidance

  • Assessment tools and tracking resources

  • Live sessions and support materials

  • Access to digital platforms and resources


3.2 What is NOT Included

The Program does NOT include:

  • Individual medical consultations or diagnoses

  • Prescription medications or medical treatments

  • Emergency medical services

  • Ongoing clinical monitoring or care

  • Treatment of acute medical conditions


4. PARTICIPANT RESPONSIBILITIES AND HEALTH ACKNOWLEDGMENTS

4.1 Health Status Disclosure

By participating, you represent that:

  • You are physically and mentally capable of participating in the Program

  • You will consult with qualified healthcare providers before implementing recommendations

  • You will discontinue participation if advised by a healthcare provider

  • You have disclosed any relevant health conditions to your healthcare provider


4.2 Voluntary Participation

Your participation in this Program is entirely VOLUNTARY. You may:

  • Discontinue participation at any time

  • Modify recommendations based on your healthcare provider's advice

  • Choose which aspects of the Program to implement


4.3 Emergency Situations

IN CASE OF MEDICAL EMERGENCY, CONTACT EMERGENCY SERVICES IMMEDIATELY (911). The Program is not designed to address medical emergencies or urgent health conditions.

5. PRIVACY AND CONFIDENTIALITY

5.1 Health Information Privacy

We are committed to protecting your privacy in compliance with applicable laws, including HIPAA where applicable. Your health information will be:

  • Kept confidential and secure

  • Used only for Program purposes

  • Not disclosed to third parties without your consent (except as required by law)

  • Maintained according to industry security standards


5.2 Data Collection and Use

We may collect information including:

  • Contact and payment information

  • Program participation data

  • Aggregate, de-identified health metrics for program improvement

  • Communications within the Program platform


5.3 Third-Party Platforms

The Program may utilize third-party platforms for delivery. Your use of such platforms is subject to their respective privacy policies and terms of service.

6. PAYMENT TERMS AND REFUND POLICY

6. Payment

  • Payment is due at the time of enrollment

  • All prices are subject to change without notice

  • Payment processing is handled by secure third-party providers


7. INTELLECTUAL PROPERTY RIGHTS

7.1 Program Content Ownership

All Program content, including but not limited to text, videos, audio files, graphics, logos, and software, is the exclusive property of the Provider or its licensors and is protected by copyright, trademark, and other intellectual property laws.


7.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use Program content solely for your personal, non-commercial use during your enrollment period.


7.3 Restrictions

You may NOT:

  • Reproduce, distribute, or share Program content with others

  • Use content for commercial purposes

  • Create derivative works based on Program content

  • Reverse engineer or extract proprietary information


8. LIMITATION OF LIABILITY AND DISCLAIMERS

8.1 Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT PARTICIPATION IN THE PROGRAM INVOLVES INHERENT RISKS. By participating, you voluntarily assume all risks associated with dietary changes, lifestyle modifications, and program activities.


8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Provider's total liability shall not exceed the amount you paid for the Program

  • Provider shall not be liable for indirect, consequential, special, or punitive damages

  • Provider makes no warranties, express or implied, regarding Program outcomes

  • Provider disclaims all warranties of merchantability and fitness for a particular purpose


8.3 Health-Related Disclaimers

Provider is not liable for:

  • Adverse health effects or complications

  • Failure to achieve desired health outcomes

  • Interactions with medications or existing treatments

  • Decisions made regarding medical care


9. COMPLIANCE WITH APPLICABLE LAWS

9.1 Wellness Program Compliance

This Program is designed to comply with applicable federal and state laws governing wellness programs, including but not limited to:

  • Americans with Disabilities Act (ADA)

  • Genetic Information Nondiscrimination Act (GINA)

  • Health Insurance Portability and Accountability Act (HIPAA)

  • Affordable Care Act (ACA) wellness program provisions


9.2 Reasonable Accommodations

We will provide reasonable accommodations for participants with disabilities. Please contact us to discuss accommodation needs.


9.3 Non-Discrimination

The Program is offered without discrimination based on race, color, religion, sex, national origin, age, disability, or genetic information.


10. USER CONDUCT AND COMMUNITY GUIDELINES

10.1 Acceptable Use

Participants must:

  • Use the Program for its intended educational purposes

  • Respect other participants and staff

  • Maintain confidentiality of other participants' information

  • Follow community guidelines in group settings


10.2 Prohibited Conduct

The following is prohibited:

  • Harassment, discrimination, or disrespectful behavior

  • Sharing personal medical information of others

  • Providing medical advice to other participants

  • Commercial solicitation or promotion


11. TERMINATION

11.1 Termination by Provider

We reserve the right to terminate your access to the Program for:

  • Violation of these Terms

  • Inappropriate conduct or behavior

  • Non-payment of fees

  • Protection of other participants' safety or privacy


11.2 Effect of Termination

Upon termination:

  • Your access to Program materials will cease

  • Confidentiality obligations remain in effect

  • Refund eligibility determined per Section 6.2


12. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

  • Email notification to participants

  • Posted notice on Program platform

  • Updated terms with effective date

Continued participation after changes constitutes acceptance of modified Terms.


13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

These Terms are governed by the laws of [Insert State/Jurisdiction], without regard to conflict of law principles.


13.2 Dispute Resolution

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Provider regarding the Program.

BY ENROLLING IN THE PROGRAM, YOU ACKNOWLEDGE THAT:

  • You have read and understood these Terms and Conditions

  • You agree to be bound by all provisions herein

  • You understand the educational nature of the Program

  • You will consult healthcare providers before implementing recommendations

  • You assume responsibility for your health and safety during participation

  • You understand that individual results may vary

  • You consent to the collection and use of information as described


ELECTRONIC SIGNATURE ACCEPTANCE:
Your electronic enrollment and payment constitutes your electronic signature and agreement to these Terms and Conditions.
